This CPD course is for the Regulated Canadian Immigration Consultants (RCICs), Lawyers, Paralegals, law graduates and students.


Description:


In the CPD session "Understanding Refugee Claims and Seeking Asylum in Canada," participants will aim to achieve concise yet comprehensive learning objectives. They will acquire a clear understanding of the refugee claim process in Canada, including the legal definitions and categories under IRPA. Participants will learn about the Non-Comparative Approach in refugee claims, explore complex cases and exceptions, particularly in relation to the Safe Third Country Agreement, and gain insights into crafting effective refugee narratives. Additionally, they will be updated on IRCC’s online asylum application process and recent legal changes impacting refugee claims. The session will enhance their practical application skills through case study analysis and interactive Q&A.

Training Agenda:


Introduction (5 minutes)


Overview of the Refugee Claim Process (15 minutes)

  • Discussing the process for claiming refugee status at Canadian ports of entry and within Canada.

Understanding Legal Definitions and Categories (10 minutes)

  • Explaining 'Convention Refugees' and 'People Needing Protection' as per IRPA Sections 96 and 97.

The Non-Comparative Approach to Refugee Claims (10 minutes)

  • Analysis of the 'Non-Comparative Approach' based on the "Ali v. Canada" decision.

Navigating Complex Cases and Exceptions (15 minutes)

  • Exploring the Safe Third Country Agreement and scenarios of ineligibility for asylum.

Crafting Effective Refugee Narratives (15 minutes)

  • Best practices for creating compelling narratives for refugee claims.

IRCC’s Online Asylum Application Process (15 minutes)

  • Overview of the new eApp system and implications for claim processing.

Recent Legal Updates and Implications (10 minutes)

  • Discussing recent changes in laws, regulations, and policies affecting refugee claims.

Case Study Analysis: (15 minutes)

  • Examining real-life scenarios to understand practical applications of the process.

Question & Answer Session (15 minutes)

  • Open floor for participants to ask questions or seek clarifications.
